Medical Malpractice

Kentucky and Indiana Medical Malpractice Lawyers

Thousands of people in the United States die each year as the result of medical error. According to a comprehensive and highly regarded hospital study by Harvard University, more than 1 million people suffer injuries each year as a result of mistakes caused by doctors, anesthesiologists, residents, nurses, technicians, and malfunctioning medical devices. Medical malpractice also occurs in other settings, such as doctors’ offices or dental clinics. Most of the victims never know that their injury was due to medical error. Most people never hear any explanation for what happened to them. Most never sue.

The overwhelming majority of doctors, nurses, therapists, and other health care providers are caring and compassionate professionals who value the safety and lives of their patients above all else. In spite of the best care, sometimes patients do not have a good result. This is not malpractice.

However, our investigations into these cases often reveal that doctors, nurses, and other health care providers hurt people because of carelessness, inattention, or simple incompetence. Whether failure to timely diagnose disease, inattention to patients and ignoring their complaints and symptoms, or birth injuries due to negligence, the results are often catastrophic. Patients suffer injuries ranging from birth defects to brain damage, to spinal cord injuries, and in many cases, the patient dies. A recent study by the Institute of Medicine recently found that simple medication errors occur on average once a day to every hospital patient, resulting in serious injuries and thousands of patient deaths.

The time limits for filing claims against doctors and hospitals are very short. In Kentucky, a medical malpractice claim must be filed within one year following the date of any injury. In Indiana, a claim must be filed with the Department of Insurance within two years following the date your injury was discovered.
